• the administrative and logistical processing of blood tests and hair analyses.

This privacy policy does not apply to the medical analysis itself, which is conducted solely under the responsibility of AZ Delta’s accredited clinical laboratory.

3. What personal data do we process?

3.1. Information You Provide Yourself

We may process the following types of data, among others:

• last name and first name;
• email address;
• phone number;
• date of birth or year of birth;
• administrative appointment details.

3.2. Identification Information for Specific Studies

For certain services that may have a medico-legal nature (e.g., alcohol- or drug-related tests), additional identification information may be requested or verified, such as:

• national registration number;
• proof of identity.

This processing is carried out only when it is necessary for the specific purpose of the service.

4. For what purposes do we process your data?

Betamedics NV processes personal data exclusively for the following purposes:

• managing and scheduling appointments;
• customer communication and administrative follow-up;
• billing and payment;
• logistical coordination of steel procurement and shipping;
• compliance with legal obligations.

Betamedics NV does not process medical data for diagnostic or therapeutic purposes.

5. Medical Information and Roles

• Betamedics NV is not a healthcare provider as defined by Belgian health law.
• Betamedics NV does not perform medical procedures, make diagnoses, or interpret test results.
• All medical tests are performed exclusively by AZ Delta’s accredited clinical laboratory, which acts as a separate data controller for medical data.
• No medical treatment agreement is formed between you and Betamedics NV.

6. Legal Basis for Processing

We process personal data based on:

• your explicit consent, where required (Article 6(1)(a) of the GDPR).
• legal obligations (Article 6(1)(c) of the GDPR);
• Betamedics NV does not process health data as defined in Article 9 of the GDPR.
• Medical data is processed exclusively by the AZ Delta clinical laboratory, which acts as a separate data controller for this purpose.

You may withdraw your consent at any time without affecting the lawfulness of the processing prior to the withdrawal.

7. Retention Periods

• Administrative and commercial personal data are retained for up to 8 weeks after the request has been fully processed or the service has been provided for routine blood draws. For hair analyses, this data is retained for up to 10 weeks after the request has been fully processed or the service has been provided. After that, the data is anonymized, unless a longer retention period is required by law, such as for accounting obligations.

• Medical records and samples are stored by AZ Delta’s clinical laboratory in accordance with its legal and ethical obligations

Betamedics NV is not responsible for the retention periods applied by AZ Delta.

8. Disclosure to Third Parties

Your personal data may be shared with:

• the AZ Delta clinical laboratory (for analysis only);
• IT and hosting service providers;
• other processors necessary for the provision of our services.

Your information will never be sold to third parties.

9. Your Rights

You have the right to:

• to access your personal data;
• to have your information corrected or deleted;
• to restrict processing;
• object to the processing;

Article 1 – Company Information

Article 2 – Scope of Application

2.1. These general terms and conditions apply to all offers, bookings, agreements, and services provided by Betamedics NV, regardless of the nature of the test or analysis.

2.2. By making an appointment (online or by phone), the customer expressly agrees to these terms and conditions.

2.3. Any deviations from these terms and conditions are valid only if they have been expressly accepted in writing by Betamedics NV.

Article 3 – Role of Betamedics NV

3.1. Betamedics NV provides exclusively commercial, organizational, logistical, and administrative services

3.2. Betamedics NV:

• does not perform medical procedures;
• does not make diagnoses;
• does not provide medical or therapeutic advice;
• does not interpret test results.

3.3. All medical tests and procedures are performed exclusively under the responsibility of an accredited clinical laboratory, specifically the Laboratory Medicine Department at AZ Delta Roeselare.

3.4. No medical treatment agreement within the meaning of Belgian health law is established between the customer and Betamedics NV.

Article 4 – Formation of the Agreement

4.1. The agreement is concluded at the moment the customer:

• books an appointment through the website or by phone; and
• actively agrees to these terms and conditions by checking a checkbox that is not pre-checked (online).

4.2. Betamedics NV reserves the right to reject an application for organizational or legal reasons.

Article 5 – Prices and Payment

5.1. All prices are in euros and include all applicable charges, unless otherwise specified.

5.2. Services Offered:

• are not reimbursed by the RIZIV;
• are entirely the customer’s responsibility.

5.3. The customer confirms that, prior to the appointment, they have been informed of the exact price of the selected service.

5.4. Payment is made in accordance with the terms and conditions provided at the time of booking or at the time of service.

Article 6 – Provision of Services

6.1. Betamedics NV undertakes to perform its services with due care, within the scope of its non-medical role.

6.2. Betamedics NV cannot guarantee that every service will be performed at an exact time, and is not liable for minor delays inherent in the scheduling of appointments.

Article 7 – Cancellation and Breach of Contract

7.1. If the customer fails to show up for the appointment or cancels late, Betamedics NV may charge for the costs incurred.

7.2. Specific cancellation terms may be provided for each service and form an integral part of the agreement.

Article 8 – Liability

8.1. Betamedics NV’s liability is limited to those cases in which it cannot be excluded by law.

8.2. Betamedics NV is not liable for:

• the collection of samples (blood, urine, hair), to the extent that it is carried out under the responsibility of the clinical laboratory or other authorized third parties
• decisions made by the clinical laboratory;
• consequential damages, indirect damages, or pure financial loss.

8.3. To the extent permitted by law and solely to the extent that this relates to the performance of this agreement, the customer irrevocably waives its right to bring any claim against the directors and employees of Betamedics NV, to the extent that they may be considered agents in the performance of this agreement.

8.4. The customer acknowledges that it may hold only Betamedics NV contractually liable, and not its agents, unless required by mandatory law.

Article 9 – Force Majeure

Betamedics NV shall not be liable if the performance of its obligations is prevented by force majeure, including (but not limited to): illness, strikes, technical malfunctions, government measures, or logistical disruptions.

Article 10 – Complaints

10.1. Complaints must be submitted in writing within a reasonable time viainfo@betamedics.com.

10.2. Filing a complaint does not suspend the obligation to pay.

Article 11 – Governing Law and Jurisdiction

11.1. These general terms and conditions are governed exclusively by Belgian law.

11.2. In the event of a dispute, the courts of the judicial district of West Flanders, Roeselare division, shall have exclusive jurisdiction.

Article 12 – Severability

If any provision is found to be invalid in whole or in part, the remainder of the terms and conditions shall remain in full force and effect.

1. Identity and Role Distribution

Betamedics NV, with its registered office at Sint-Martinusstraat 15, 8800 Roeselare (Oekene), VAT BE0642.736.252, acts exclusively as a commercial and organizational service provider.

Betamedics NV:

• does not perform medical procedures
• does not make diagnoses
• does not provide medical or therapeutic advice
• does not interpret medical results

All hair analyses are performed under the exclusive medical responsibility of AZ Delta’s accredited clinical laboratory.

No medical treatment agreement is formed between the Customer and Betamedics NV. The Customer expressly acknowledges that Betamedics NV is not a healthcare provider within the meaning of Belgian health law.

2. Purchase Procedure

• You are not allowed to cut your own hair prior to the hair analysis.
• The sample is collected by authorized staff at the crown of the head, directly from the scalp.
• Cosmetic treatments (such as coloring, decoloring, bleaching, perms, or other chemical treatments) must be disclosed accurately and in full at the time of purchase.
• Removing one or more strands of hair can have a noticeable effect on the hairstyle.
• If the hair is too short, lacks sufficient volume, or if there is any doubt regarding the integrity of the sample, Betamedics NV and/or the clinical laboratory reserves the right to refuse to collect or analyze the sample.

By making payment in advance and attending the appointment, the Customer agrees to the service and acknowledges its potential consequences and limitations.

3. Analysis and Review Period

• A strand of hair that is, on average, 1 cm long is equivalent to about 1 month of hair growth.
• Analysis can be performed on a strand of hair up to 6 cm long, which provides information covering a period of up to 6 months.
• Hair growth rates can vary from person to person, so the estimated time frame may differ.
• Concentrations above established cut-off values (decision limits) are considered evidence of exposure to the substance in question.
• A positive result indicates that the substance was used during the period under investigation, but does not indicate exactly when this occurred.

4. Limitations of Hair Analysis

External factors such as:

• UV radiation
• heat
• cosmetic treatments
• exposure to chlorinated water or other chemical agents

can affect hair quality and make analysis more difficult or even impossible.

A negative result does not rule out use outside the period under investigation.

If a competent authority (such as a magistrate or attorney) declares the analysis invalid for technical, procedural, or sample-related reasons, neither the AZ Delta clinical laboratory nor Betamedics NV can be held liable for this, except in cases of willful misconduct or gross negligence.

5. Handling of Results and Confidentiality

• The results are analyzed by the clinical biologists at AZ Delta and accompanied by a general conclusion.
• The results are sent exclusively to the person who underwent the hair analysis.
• The Customer is responsible for transferring the proceeds to any third parties (such as courts or attorneys).
• Betamedics NV and AZ Delta are not responsible for any further medical follow-up or legal interpretation of the results.
• All samples are stored and destroyed by the AZ Delta clinical laboratory in accordance with the applicable legal and ethical obligations.

6. Cost

All costs associated with the hair analysis are the full responsibility of the Customer and are not eligible for reimbursement by the RIZIV.

The Customer confirms that they have been informed in advance of the exact cost and agrees to pay in full in advance prior to delivery.

7. Liability of Betamedics NV

Betamedics NV is not liable for:

• delays in the processing of results that are beyond its reasonable control
• the lack of results due to unsuitable, insufficient, or damaged hair samples
• effects of external factors that influence the analysis
• incorrect or incomplete information provided by the Customer

8. Directors, Employees, and Agents

To the extent permitted by law and solely for the purposes of performing this agreement, the Customer waives any right to bring any contractual or non-contractual claim against the directors, permanent or temporary staff, and employees of Betamedics NV, to the extent that they act as vicarious agents within the meaning of Article 6.3 of the Civil Code in the performance of this agreement.

This limitation of liability does not apply in cases of willful misconduct, gross negligence, or in other cases where a limitation of liability is not permitted by law.

9. Consent and Digital Agreement

By checking the required checkbox, the Customer declares that he or she:

• has read and understood these terms and conditions and this consent form
• agrees to the hair sample collection and analysis
• accepts the limitations and possible consequences
• expressly consents to the processing of personal data in accordance with the privacy policy

This digital agreement has the same legal validity as a written signature.
